What is Proposition 1?

Proposition 1 – 발의안 1 은 무엇인가?  반대해야 할 이유 (Why Oppose)

Proposition 1, if passed by voters in November, will amend the California Constitution to say that the state cannot “deny or interfere” with a woman’s right to an abortion. The language of the proposition does not set limitations on when the abortion can take place during the 40 weeks of pregnancy, sometimes called late-term abortion. 

만약,  오는 11월 유권자들에 의해 발의안 1호(Prop. 1) 가 통과된다면 이 발의안은 함부로 손대서는 안되는 캘리포니아 헌법까지도 개정할 뿐 아니라, Prop. 1의 법적 내용에 의해 여성의 낙태 권리를 '부정하거나 간섭할 수 없다'라는 내용을 절대적인 것처럼 통과시키게 된다.  Prop. 1의 내용에 의하면, 임신 40주 동안 여성은 언제든지 “말기 낙태-late abortion” 까지도 자유로이 할 수 있도록 낙태 제한을 전혀 두지 않는다.  

Currently, late-term abortion is prohibited in California unless the procedure is necessary to protect the health or life of the mother, up to the point of viability. Viability means that the fetus could survive outside the uterus which is at approximately 24 weeks (or six months.) 

현재 캘리포니아에서는 산모의 건강이나 생명을 보호하는 명목으로 이미 태아생명보다 산모의 생명을 우선순위로 한다.  하지만 산모의 건강, 생명보호를 위해 꼭 필요한 절차가 아닌 이상, 생존가능성(viability)이 있는 태아에 대한 말기 낙태는 금지되어 있다.  생존가능성이란 태아가 엄마 자궁 밖에서도 생존할 수 있는 태아로서 보통 24주 또는 6개월이된 태아를 의미한다.    

The language of Proposition 1 is a straightforward three sentences. 

발의안 제1호의 언어는 세 문장으로 되어 있다.

The state shall not deny or interfere with an individual’s reproductive freedom in their most intimate decisions, which includes there a fundamental right to choose to have an abortion and their fundamental right to choose or refuse contraceptives. This section is intended to further the constitutional right to privacy guaranteed by Section 1, and the constitutional right to not be denied equal protection guaranteed by Section 7. Nothing here in narrows or limits the right to privacy or equal protection.
캘리포니아 주정부는 사적인 개인의 결정을 포함하여, 한 개인의 낙태 또는 피임약을 선택하거나 거부할  ‘생식, 낙태의 자유’ 를 부정하거나 방해해서는 안 된다.   (Prop. 1) 법안 문구는, 캘리포니아주 헌법의 제 1조항(Section 1)이 헌법상 보장해주는 사생활 권리와, 제7조항 (Section 7)이 보장해주는 동등한 보호를 거부당하지 않을 헌법상의 권리를 증진 및 확장 시키기 위한 것이 목적이다.  이 조항에 있는 그 어떤 것도 사생활의 권리나 동등한 보호를 줄이거나 제한할 수 없다. 

The proponents of Prop. 1 should have included limitations on aborting viable babies in the language but failed to do so.
문제의 소지 내용(Issue):  Prop. 1(발의안 1)을 지지하는 입법자들은 법안내용 안에 생존가능한 건강한 태아들을 아무 때나 (태아의 건강, 나이에 상관없이) 낙태하는 것에 대한 제한(limitation)을 법안내용에 포함시켰어야 했지만, 이들은 전혀 포함하지 않았기에, 낙태를 ‘말기 낙태’ 까지 가능하도록 열어놓았다.

Abortion in the late-term is cruel and extreme, even for California.
낙태 중에서도 “말기 낙태: late-term” 는 잔인하고 극단적이라는 것이 아직까지도 캘리포니아 시민들의 다수의견이다. 

We urge a NO vote on Proposition 1. 

따라서,  Prop. 1에 대해 꼭 반대 투표를 촉구합니다!
